On 30 July, Italy published in its Official Gazette a new implementing act on the legislation on the right to be forgotten (Oblio oncologico), dated 5 July. The new act outlines the procedures for issuing certificates that attest to an individual’s right to be forgotten regarding their oncological history.
Italy passed the law on 7 December 2023, which came into force on 2 January 2024, and has since been working on implementing acts (“Decreti Attuativi”).
Four implementing acts were foreseen by the law, to be issued by the Ministries of Health, Justice and Labor and Social Policies.
Two acts still remain to be devised to effectively protect Italian cancer survivors from financial discrimination. One preventing discrimination against individuals applying for adoption and another for the promotion of policies to ensure survivors have equal opportunities in the workplace.
Additionally, two resolutions, to be issued by the Interministerial Committee for Credit and Savings and Institute for the Supervision on Insurance Policies, are still expected.
The implementing acts are absolutely necessary to ensure survivors are fully protected by the RTBF law.
